Scientific research work
Priorities in scientific research activity:
- Comparative Law.
Within the framework of this approach we carried out the scientific researches supported by the governmental grants:
- «Sources of the Law in the Republic of Belarus: theoretical and practical aspects»,
- «Methods of reception and implementation of the foreign legal experience»,
- «Influence of the mechanisms of modern legal systems (theory and practice of the legal system development in Belarus)»,
- «Problems of formation of private law in the legal system of the Republic Belarus».
Two PhD in Law dissertations were prepared and presented (the degree of the candidate of jurisprudences were awarded):
- Alexei V. Egorov. The mechanism of the legal reception in system of the legal integration (Minsk, 1999);
- Alexandra G. Egorova. A foreign element in the national law (Minsk, 2002).
One of most remarkable results of this comparative research is publishing of the monographic study book «The Basics of the Comparative Law» (Novopolotsk, 1999. – 276 pages). This book is one of the first publications in our national law literature. It illustrates systematic methodological and practical studies in comparative law. The technique offered by this book allows studying the foreign legal element on the basis general theoretical provisions of the comparative law science, that promotes the formation of complex knowledge in the field of comparative legal research.
As a logical continuation of the comparative studies development, we introduced in the educational process new subjects such as «Comparative Law»,«Civil and Commercial Law of Foreign Countries». More than 40 scientific articles were published.
- Legal regulation of oil and gas transportation.
Publication of monographic books «Legal regulation of oil and oil products trasportation by pipelines» (Novopolotsk, 2002, 112 pages) and «Legal regulation of gas transportation by main pipelines» (Minsk, 2004, 216 pages) written by Vladimir A. Bogonenko became one of the most important results of our research to the mentioned direction. These books are devoted to study of problems of the legal regulation in the filed of research. They give legal characteristic to pipeline transportation contracts, study foreign legislation and international law on this issue. Totally 25 articles were published in relation to this topic.
- Problems of formation of new Private Law institutions in the legal system of Belarus.
The core of this research line is the governmental grant «Problems of integration of new institutions of Private Law in Belarus» (2003-2005 years) holding in cooperation with the Institute of State and Law of the National Academy of the Republic of Belarus. Presently, 22 scientific works have been published in this filed of research.
Scientific cooperation
One of the basic principles of scientific research of our Department is developing of scientific relations with representatives of other scientific schools of other faculties of law (Belarusian State University, Grodno State University, Institute of State and Law of the National Academy of the Republic of Belarus).
Our Department is looking forward in order to establish multi-beneficial long-term cooperation with similar departments of the law faculties in the CIS, Europe and over the world concerning the following directions:
- joint scientific and educational projects in frameworks of Tempus, INTAS, other programs;
- joint edition and publishing of scientific journals and separate researches in Civil Law, Commercial Law, Family Law, Land Law, Financial Law, International Private Law, Comparative Law;
- inter-exchange of visiting lecturers (on the basis of international agreements on cooperation);
- inter-exchange of students (on the basis of international agreements on cooperation).
One of the most significant events for our Department is participation in all-European educational program Tempus under the aegis of European Union. Application filed by the Department in 2004 was named as of the most prospective and promising projects and grant to realize this project was awarded. The Tempus project will be realized by the Department in cooperation with universities of Sweden, Finland, the Netherlands in 2005-2006. As a main result of the project, we assume to develop and distribute the training program «Real Estate Law», to create new techniques of teaching, training and drafting of methodical materials in this filed of the law.
